Onsight Education, LLC — Website Terms of Use

1. Agreement to these Terms

These Terms of Use (“Terms”) govern your access to and use of onsighteducation.com and any content, functionality, or forms offered on it (the “Site”). The Site is operated by Onsight Education, LLC, an Oregon limited liability company (“Onsight,” “we,” “us,” or “our”), located at 2171 NE Weidler St, Portland, OR 97232.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. The Site is informational

The Site describes Onsight’s services and lets you contact us or join a waitlist. It is not the service itself. Nothing on the Site is an offer to provide instruction, and submitting a form does not create any obligation on Onsight to provide services or on you to purchase them.

Tutoring and music instruction services are provided only under a separately executed Onsight Client Service Agreement. If anything on the Site conflicts with that Agreement, the Agreement controls.

3. Eligibility

You must be at least 18 years old to submit any form on the Site. If you are inquiring about instruction for a minor, you represent that you are that minor’s parent or legal guardian, or are otherwise authorized to act on their behalf.

Please do not submit a child’s personal information through the Site beyond what a form specifically asks for, and do not submit sensitive information such as medical details, Social Security numbers, or financial account information through a website form. We will collect what we need through a secure channel once we are working together.

4. Waitlist and contact submissions

Information you submit through a Site form is handled in accordance with our Privacy Policy. Joining the waitlist does not reserve a place, guarantee availability of any instructor, or guarantee any particular rate. We may contact you about Onsight services; you can ask us to stop at any time.

5. Instructor applications

If you apply to instruct through Onsight, you agree that the information you provide is accurate and complete, and you acknowledge that engagement is subject to Onsight’s screening process, including a background check conducted with your separate written authorization. Applying does not create an employment relationship, a contractor relationship, or any obligation on Onsight to offer you work.

6. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms;
  • Submit false, misleading, or impersonating information;
  • Submit content that is defamatory, harassing, obscene, or that infringes anyone’s rights;
  • Attempt to gain unauthorized access to the Site, its servers, or any connected system;
  • Introduce malware or any other harmful code;
  • Use any automated system to scrape, harvest, or copy content from the Site; or
  • Use the Site or its content to build or promote a competing service.

7. Intellectual property

The Site and its contents — including text, blog posts, graphics, logos, images, page layout, and the Onsight name and mark — are owned by Onsight or its licensors and are protected by intellectual property law. You may view and print Site content for your own personal, non-commercial use. Any other reproduction, distribution, modification, republication, or commercial use requires our prior written permission.

8. Educational content is general information

Blog posts, guides, and other educational content on the Site are general information. They are not individualized educational, academic, medical, psychological, or legal advice, and they do not account for any particular student’s circumstances. Nothing on the Site guarantees any academic result, test score, admission outcome, audition result, or rate of musical progress. Do not rely on Site content as a substitute for advice from a qualified professional who knows your situation.

9. Third-party links and services

The Site may link to or embed third-party websites and services we do not control. We provide those links for convenience and do not endorse and are not responsible for their content, products, or practices. Your use of a third-party site is governed by that site’s own terms.

10. Privacy

Our collection and use of information through the Site is described in the Onsight Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that any information on it is accurate, complete, or current.

12. Limitation of liability

To the maximum extent permitted by law, Onsight and its members, officers, agents, and contractors will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to your use of the Site, including lost profits, lost data, or loss of goodwill, whether or not we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred dollars ($100). This limitation does not apply to liability arising out of services delivered under a Client Service Agreement, which is governed by that Agreement, and does not limit any liability that cannot be limited as a matter of Oregon law.

13. Indemnification

You agree to indemnify and hold harmless Onsight and its members, officers, agents, and contractors from any claim, loss, liability, or expense, including reasonable attorney fees, arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

14. Changes to the Site and these Terms

We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also revise these Terms; the “Last updated” date above will reflect any revision. Your continued use of the Site after a revision means you accept the revised Terms.

15. Governing law and venue

These Terms are governed by the laws of the State of Oregon, without regard to conflict of laws principles. Any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Multnomah County, Oregon, and you consent to that jurisdiction and venue.

16. Severability and waiver

If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable or, failing that, severed, and the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of it.
